All the products have been cut by hand, being checked at the moment of cutting by professionals who guarantee the good condition of the product, carrying out a careful quality control as well as of the salt and curing point.
Thegoodjamon.com guarantees the quality and quantity of all its products. Therefore, if the product does not comply with what was agreed in the order or there is any incident that prevents its consumption, the customer will have a period of 24 hours from the receipt of the order to communicate the detected incident by sending an e-mail to contact@thegoodjamon.com, stating clearly and in detail the reasons for non-compliance and accompanying the evidence available.
Personal opinions about aesthetic considerations of the product, will not be considered defects of the product. Jamón is a salty product, so any refund claims based on this element or the curing point will have to be definitively double checked by thegoodjamon.com upon receipt.
In any case, as these are products for short-term consumption, the right of withdrawal by the customer once the order has been placed will not be considered.
If in any case the return is initially accepted by thegoodjamon.com, the order will be returned through the courier indicated by thegoodjamon.com in the same conditions of delivery. Return shipment costs will be charged to the customer in the first place and settled by bank transfer, although both the product price and return shipment fees will be refunded by bank transfer once thegoodjamom.com receives the product and effectively confirms that the incident relates to its consumption (e.g. excess salt or curation point) or defects in blisters/product upon initial shipment.
If a product other than that requested by the customer was delivered by mistake by thegoodjamon.com, it will be withdrawn and will be delivered the correct product without any additional charge to the buyer or will be credited the amount paid, according to customer preference. Similarly, in the event of any delay in receiving the order (more than 7 days from the expected date of delivery) or loss in shipping, thegoodjamon.com will deliver an order of similar characteristics at no cost or will be credited the amount paid by the customer.
Art. 123 of the Revised Text of the General Law for the Defence of Consumers and Users (TRLGDCU), which establishes a period for responding to the lack of conformity from delivery or the period within which the consumer must report the lack of conformity, will not apply to these products as both periods are above the normal consumption period of these products and because the owner cannot verify that the reason is not a result of incorrect use by the consumer.
According to art. 103 TRLGDCU, the right of withdrawal shall not apply to contracts relating to (among others):
- d) The supply of goods which are likely to deteriorate or expire rapidly.
- e) The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.
In relation to this paragraph with the User’s order, the User gives his prior express consent with the knowledge on his part that he consequently loses his right of withdrawal.
According to art. 115bis of the TRLGDCU on the subjective conformity of the products with the contract, it is stated that: 1) In the absence of proof to the contrary, the products shall be deemed to be in conformity with the contract provided that they meet all the requirements set out below: a) They conform to the description given by the seller and possess the qualities of the product that the seller has presented to the consumer and user in the form of a sample or model. b) They are suitable for the uses to which products of the same type are normally put. c) They present the usual quality and performance of a product of the same type that the consumer and user can reasonably expect, taking into account the nature of the product (…) In any case we indicate that the photos of products shown may vary in terms of size, colour, appearance, etc., as is normal in the case of natural, non-manufactured products. The purpose of the photographs will be the orientation for the consumer or suggestions of presentation, without supposing in no case contractual images.
